By accessing the Platform, registering your information, or utilizing the services provided by the Company, you, hereinafter referred to as "You," "Your," "Customer," or "User," agree to abide by these Terms and Conditions ("Terms"). These Terms, in conjunction with the Privacy Policy, govern SoftScience's association with You and are subject to the regulations, guidelines, policies, terms, and conditions applicable to any Service provided through the Platform. They are considered integral parts of the Terms.
Your acceptance of these Terms occurs when You visit the Platform, sign up for, access, or utilize any of our Services, including but not limited to features, technologies, or functions offered on our Platform, encompassing products and services collectively referred to as "Services." Notably, Services do not cover products or services offered by third-party service providers through the Platform.

If You do not agree with the Terms, You are advised not to use the Services or visit the Platform.The User's ability to access and utilize the Platform or Services is contingent upon their acceptance and adherence to these Terms. The Terms are classified as 'electronic records' as defined by applicable information technology laws and respective rules, which may be amended from time to time. These Terms are generated by a computer system and do not necessitate any physical or digital signatures.

The parties involved in this agreement, collectively referred to as "User/Users / You / Your / Customer” include visitors, viewers, users, subscribers, members, affiliates, or customers. In situations where the context may necessitate, in situations where the context may necessitate, Users shall be considered to encompass any business or entity for which the Services are accessed by another User, as well as any such business or entity, and any individual acting on behalf of such a business or entity in relation to the use of the Services. The User shall bind such business or entity to the terms of use. Throughout this Terms of Use, references to User also encompass the represented business or entity. Eligibility of the individual user should be in confirmation to be a resident of India with minimum of 18 years of age along with capacity to enter a legally binding contract as specified under the Indian Contract Act, 1872, while accessing the Platform and/or availing the Services offered by the Company and not being barred or otherwise or using the Services under the laws of India or any other applicable law. Eligibility for representatives of the business or entity is subject to business or entity in accordance with applicable laws with valid and requisite certifications / affiliations with necessary provisions under the constitution documents. Any use of the Site by individuals who are not authorized representatives of the business or entity, including representatives for whom Registration Data has not been provided, nullifies this license and constitutes a breach of these Terms. Additionally, we retain the right to revoke this license for the business or entity member and/or any person acting on their behalf, with or without cause, and with or without notice.
SoftScience, along with its subsidiaries, is the entity responsible for creating this Platform. Consequently, the owners and/or operators of SoftScienceand its subsidiaries are also considered parties to this Agreement.
The Company may periodically amend these Terms. The updated Terms will be published on the website and will display the date of the most recent revision at the top of this page. Your ongoing use of the Services following these modifications constitutes your acceptance of the updated Terms.
The Company retains the right to cease or temporarily suspend the Services, including associated services, with reasonable advance notice, on a best-effort basis, except in cases where it is solely for altering specific features or content of the Services and/or Platform, or to uphold the security and integrity of the Services. You acknowledge and agree that the Company will not be held liable to You in any manner for any adjustments or discontinuation of the Services.
To utilize the Services on Our platform, you might have to register and provide us with accurate and complete information, as requested. It is essential to ensure that this information remains up-to-date in all aspects at all the time with us.
SoftScience retains the authority to suspend any account or restrict a User’s access to the Platform or Services if it is determined that the provided information is false, erroneous or in violation of the Terms. When accessing the Services and third-party products or services, specific additional terms and conditions will be applicable. The User needs to / free to review these additional terms and conditions thoroughly before acceptance.
You are solely responsible for maintaining the confidentiality of your Login ID and Password, which grant you access to the Platform. Any activities conducted through your account and/or password are your responsibility. Promptly notify us if you suspect or observe any unauthorised use of your access / account. SoftScience is not liable for any unauthorised access or use of your account, including any resulting losses.
Softscience takes the privacy of its Users and the details furnished by the User on our Platform with adequate seriousness. For the current privacy policy, kindly visit our platform. We may listen to and / or record phone calls between You and our representatives without notice to you as permitted by applicable laws in India and not limited to for quality monitoring purposes.
You recognize and consent that SoftScience is the sole owner of all rights, ownership, and interests in the Services and the Platform, including any intellectual property rights associated with the Services (whether registered or not) and the Platform. Additionally, you acknowledge that the Services may contain information designated as confidential by SoftScience, and you agree not to disclose such information without prior written consent from us.
SoftScience grants you a limited license to access and use the Platform and the Services for personal desired purposes. This license does not grant you the right to download, copy, create derivative works, modify, reverse engineer, sell, assign, sublicense, or transfer any rights in the Services and the Platform. You are not permitted to use any of SoftScience’s trade names, trademarks, service marks, logos, domain names, or other distinctive brand features. Removing, obscuring, or altering any proprietary rights notices (including trademark and copyright notices) affixed to or contained within the Services is prohibited. You may not copy or transmit any contents of the Platform, and you shall not use the Platform or its contents for commercial purposes or engage in speculative, false, or fraudulent transactions.
You are prohibited from using any automatic or manual means, such as "deep-linking," "page-scraping," "robots," "spiders," or similar methods, to access, acquire, copy, or monitor any part of the Platform or its content. This includes attempting to obtain materials, documents, or information through any means not intentionally provided by the Platform. We retain the right to prohibit such activities.
You must provide Softscience information that is accurate, complete and current at all times. Basis the information, access shall be provided on our platform. Failure to keep us updated with up-to-date information about you may result in immediate termination of the user’s account with us. User will only use his granted access on our platform for own’s internal, non-commercial use and not on behalf of or for the benefit of any third party and only in a way that complies with relevant and applicable laws in India
Furthermore, the User affirms, guarantees, and commits not to submit any Content/User Submission or utilize the Service in a manner outlines hereunder. A breach of any of the aforementioned terms may result in the termination of the User's right to use or access the Service / Platform.
You agree not to misrepresent your identity, conceal your identity, or manipulate identifiers to obscure the origin of any communication sent to us through the Platform. You may not pretend to be someone else or impersonate any individual or entity.
You acknowledge and agree that for any financial transactions, third-party products and services accessed through the Platform, or for using the Services, SoftScience, or its partner financial institutions, vendors, service providers, business partners, agents, or any other third party may conduct client/customer due diligence measures and request mandatory information required for Know-Your-Customer ("KYC") purposes, as mandated by the Reserve Bank of India. SoftScience may also conduct enhanced due diligence in case the KYC documents seems to be inadequate in ascertaining yours purpose and business activity.
Softscience maintains the authority to suspend or close accounts linked to Users who partake in any of the forbidden activities as outlined above or in any way that contravenes our Terms or any other guidelines. Moreover, SoftScience retains the prerogative to conclude any account at its discretion, without providing prior notice to the Users.
Upon termination, the User's privilege to utilize the Service will promptly come to an end. If the User desires to close their account, they may do so by discontinuing use of the Service.
The User acknowledges and agrees that in no event or under any circumstances shall the company, its directors, employees, or agents be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages related to loss of profits, goodwill, use, data, or other intangible losses, even if SoftScience has been informed of the potential for such damages. These damages may arise from: (i) the User's access to, use of, or inability to access or use the Service; (ii) the actions or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of the User's content. This applies regardless of whether the claim is based on warranty, contract, tort (including negligence), or any other legal theory, and even if a remedy outlined here is determined to have failed in its primary purpose.
The User agrees to indemnify and protect SoftScience, its partners, officers, employees, agents, representatives, and its affiliates from all claims (including legal fees), liabilities, actual or consequential damages, losses, and expenses arising from, or in any way connected to, third-party claims related to (a) the User's use of the Services (including any actions taken by a third party using the User's account), and (b) the User's violation of these Terms. In the event of such a claim or legal action ('Claim'), SoftScience will make an effort to notify the User using the contact information associated with the User's account held by us (provided that failure to deliver such notice will not exempt or reduce the User's obligation to indemnify as described herein).
The Service may include links to third-party websites or services that are not owned or operated by SoftScience. SoftSciencelacks control over and disclaims any responsibility for the content, privacy policies, or practices of any third-party websites or services. Users also acknowledge and agree that SoftScience is not to be held responsible or liable, directly or indirectly, for any damage or loss purportedly caused by or connected with the use of or reliance on any such content, goods, or services available through any such Websites/Platform or Services. SoftScience strongly recommends that Users review the terms and conditions as well as the privacy policies of any third-party Websites/Platform or Services you visit.
SoftScience cannot guarantee the accuracy of any User Content or Third-Party Content. While we establish guidelines for User behaviour and posting, we do not oversee nor assume responsibility for any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content that you may come across on the website / Platform, or in connection with any User Content or Third-Party Content. The service provided herein, including services hosted by third parties, is offered on an "AS IS" and "AS AVAILABLE" basis. SoftScience explicitly disavows all forms of representations and warranties, whether they are express, implied, or statutory. This includes warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, security, and protection against the loss or corruption of User data.
The Services may undergo temporary unavailability for maintenance or other reasons. The Company accepts no liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, failure in communication lines, theft, destruction, or unauthorized access to, or alteration of, User communicationlines, theft, destruction, or unauthorized access to, or alteration of, User communications.
Softscience is not liable for any issues or technical malfunctions related to any telephone network or lines, computer online systems, servers or providers, computer equipment, software, email failure, or players, due to technical problems or internet traffic congestion, or a combination of these, including harm or damage to Users' or any other persons' computers in connection with the web and/or the Services/Platform. Under no circumstances will we be accountable for any loss or damage, including loss or damage to any User Content, financial losses, lost profits, loss of business, or personal injury or death, resulting from anyone's use of the Services.
You specifically agree that your use of the services is at your sole risk. We reserve the right to retract or remove any information from the Website / Platform at any time at its discretion. To the fullest extent permitted by the applicable law, SoftScience renounces all warranties, express or implied. Softscience does not guarantee that the Website/Platform, its servers, or Emails sent from Softscience are free of viruses or any other harmful components. Softscience shall not be liable for any damages of any kind arising from the use of the Website/Platform, including, but not limited to direct, indirect, incidental, punitive and/or consequential damages.
These Terms shall be governed by the law of India and subject to the provisions of binding arbitration, the courts at Faridabad, Haryana, India shall have the exclusive jurisdiction. Any legal claim or cause of action the User may have regarding the Service or the Platform must be initiated within one (1) year from when the claim or cause of action first arises. Otherwise, it will be considered time-barred.
Any disagreement, dispute, or claim arising from or related to these Terms, including their creation, understanding, violation, or conclusion, including questions about arbitrability, will be submitted for resolution through binding arbitration as outlined by the Indian Arbitration & Conciliation Act, 1996, with any subsequent amendments. The location for arbitration proceedings shall be in Faridabad, Haryana, India. Both the parties consent that the arbitration decision will be final and binding.
The Company's failure to assert or enforce any right or provision stated in these Terms does not waive that right or provision in this or any other instance. Should any provision of these Terms be deemed invalid, the remaining provisions will remain in full force and effect. If any provision is considered unlawful, void, or unenforceable for any reason, it will be considered separate from these Terms and will not impact the validity and enforceability of the remaining provisions.
These Terms constitutes the complete agreement concerning the Platform/Service, and they override and replace any previous agreements between the parties regarding the Platform/Service.
SoftScience retains the exclusive right to amend or substitute these Terms, exercising its discretion, at any given time. In the event of a substantial revision, SoftScience will give a minimum of 15 days of notice before the new terms come into effect. The determination of what qualifies as a significant change will be made at SoftScience's exclusive discretion.
By persisting in accessing or utilizing the Platform/Service after these revisions are implemented, the User concurs to abide by the modified terms. If the User disagrees with the updated terms, they must cease using the Service.
